According to the newest reports regarding Josh Duggar’s situation, his lawyers are now trying to get his trial moved to next year. Currently, it is set to begin in just a few weeks.
On June 18, it was revealed that Josh’s lawyers filed a motion to delay the trial until February 2022, instead of July 6, 2021. As Mamas Uncut previously reported, Josh is currently on house arrest while being looked after by family friends.
The soon-to-be father of seven was arrested and later charged with receiving and possessing child pornography. He later pled not guilty to the charges and was granted bail under strict conditions.
Those conditions include not being around minors. The only minors he could be around are his own children, so long as his wife, Anna Duggar is present.
Josh Duggar’s Lawyers File Motion to Get His Trial Pushed to 2022
Now, according to Fox News, it has been revealed that Josh Duggar hired an independent computer forensic expert to examine all of the devices seized during the raid that led to his arrest. It was also reported that this process could take months, which is why the motion was filed.
It was further revealed that Josh’s lawyer Justin Gelfand, has several scheduling conflicts. He wrote in the motion that he has federal criminal trials beginning in July, September, October, and November.
He claimed that because of that, he won’t have enough time to build a solid defense.
According to Homeland Security Special Agent Gerald Faulkner testimony for the prosecution, Duggar allegedly downloaded computer files depicting child sex abuse three different days in May of 2019. He specified the dates as the 14th, 15th, and 16th.
According to Yahoo!, the files were first flagged by a police detective in Little Rock, Arkansas. Those files were then traced back to an IP address that belongs to Josh Duggar’s computer at this workplace, the Wholesale Motorcars dealership.
Sadly, Faulkner described one of the files revealed the sex abuse of a child ranging from 18 months to 12 years of age. He added that the images were “in the top five of the worst of the worst that I’ve ever had to examine.”
It was also revealed that even though Duggar had software on his computer called “Covenant Eyes,” he had allegedly been using a password-protect network which did not register through the “Convenant Eyes” software.
Faulkner explained that the software is known as an “accountability software” that would report offensive or distasteful internet usage to the person’s partner. The report would go to his wife of 13 years, Anna, who is currently pregnant with their seventh child.
It’s unclear if a judge will grant Josh’s lawyers latest motion to move the trial to next year. If it is not granted, his trial will start in July.
